Your Gun Rights: The Court Finally Takes A Case
For the past decade, the United States Supreme Court has taken a pass when it comes to cases involving 2nd Amendment rights. This week, they announced that they have accepted a major one, which could have far-reaching implications for American gun owners.
Certiorari has been granted to the case of NY State Rifle & Pistol vs. Corlett. The case centers on the long standing New York practice (Since 1913) of requiring license applicants to show “proper cause” to obtain a gun license for self protection. In short, those who wish to obtain a gun license for defensive purposes must show a “special need” for self defense, rather than a general desire for protection. The plaintiffs argue that this is too restrictive, and deprives New York residents of their 2nd Amendment rights.
Gun control advocates fear that a pro-gun ruling in Corlett would undo years of creeping anti-gun legislation and regulation, allowing for a more permissive atmosphere for firearms licensing. 2nd Amendment proponents look forward to a ruling that will dismantle an overly-restrictive regulatory requirement, and allow citizens to obtain firearms for self-protection without citing a specific danger or threat.
The case is expected to be argued in the Fall of 2021
